Workers Compensation

Minnesota Law requires an insurance company to pay for the services you need so you can get better and get back to work. The insurance company must pay for medical treatment and lost wages related to your work injury. Unfortunately, many times the insurance company will give you the run around and pay less than what they owe. This can make it impossible for the injured person to get the treatment they need and to make ends meet in the mean time.

Every workers compensation case is different. Some claims are denied from the very beginning and we have to go all the way to Court before the insurance company honors its obligations. In Minnesota there are basically 4 different types of workers compensation benefits. These benefits include medical, wage loss, compensation for permanent injury, and rehabilitation benefits. Sometimes an injury is so bad that the person cannot physically go back to work at their old job. The insurance company must help you find a new job or in some circumstances send you back to school to get a job that you can do. The law looks to the nature and extent of your injury to determine what benefits you are entitled to.

You are still entitled to Workers' Compensation benefits even if:

  • You are part of a union
  • You no longer work for your date of injury employer
  • You only worked for your date of injury employer for a short time
  • You don't speak English
  • You don't think your employer has workers compensation insurance
  • You are paid in cash
  • Your employer threatened you with being fired
  • Your immigration status
